Terms of Use

By accessing or using vyan.ai (the “Site”), you agree to be bound by these Terms of Use. If you do not agree, do not use the Site. These Terms govern your use of the Site only; they do not govern the use of the VYAN AI platform itself, which is provided under separate written agreement.

You may view, browse, and read material on the Site for informational and evaluation purposes. You may print, save, or share a copy of any individual page or downloaded artifact for your own internal business use, provided you keep all copyright, trademark, and other proprietary notices intact and do not remove any visible or embedded attribution (including the per-page footer line that appears on downloaded Points of View).

You may not, and may not allow others to:

• Modify, adapt, translate, reverse engineer, or create derivative works from material on the Site, except as expressly permitted.
• Strip, alter, or obscure any copyright, trademark, watermark, footer, or other proprietary notice.
• Use any robot, scraper, or other automated means to access the Site, except for well-behaved search-engine indexing that respects our robots.txt.
• Use the Site or its content to develop, train, or evaluate any machine-learning model, language model, or other AI system, whether for your own use or for a third party, without our prior written consent.
• Republish, redistribute, sell, sublicense, or commercially exploit material on the Site or downloaded from it.
• Use the Site in a manner that violates applicable law, infringes any third party's rights, or interferes with the operation of the Site or the experience of other users.
• Attempt to gain unauthorised access to gated content (including The Field, The Platform, or other customer-only resources) without explicit approval from VYAN AI.
• Submit false, misleading, or impersonated information through any form on the Site.

All material on the Site — including text, graphics, animations, icons, the VYAN organism visual and any derivative animation (BreathingOrganism, the Aquarium board, the Jigsaw scene, the Resilient archer scene, and the composes ring stage), the vocabulary and definitions of Decision Twin, Decision Policy, Decision Resilience Score, Resilient EVA, Policy Value Add, and SAGE, the editorial framings and arguments in the Points of View essays and concept entries, and the source code of the Site itself — is the property of VYAN AI or its licensors and is protected by copyright, trademark, and other intellectual property laws. No license is granted to you except for the limited permitted use described above.

VYAN, the VYAN word mark, the AIR mark, SAGE, the Decision Twin mark, and related logos and indicia are trademarks of VYAN AI. Other product names mentioned on the Site are the property of their respective owners and are referenced for descriptive purposes only.

Certain materials on the Site — including but not limited to The Field, The Platform, and individual Points of View — are made available only to validated prospects and customers. When you request access, you represent that the information you provide (name, work email, phone, title, company, country) is accurate and current, and that you are authorised to request this content on behalf of the organisation you represent. We may revoke access at any time. Material made available to you under a gate is subject to all the restrictions in the Prohibited use section above and is provided for your internal evaluation only.

The Site may contain links to third-party sites. We do not control and are not responsible for the content, policies, or practices of third-party sites. Inclusion of a link does not imply endorsement.

THE SITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. VYAN AI DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT ANY INFORMATION OBTAINED THROUGH THE SITE IS COMPLETE OR ACCURATE. INFORMATION ON THE SITE IS FOR GENERAL EDUCATIONAL PURPOSES AND IS NOT INTENDED AS PROFESSIONAL, LEGAL, FINANCIAL, OR INVESTMENT ADVICE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL VYAN AI, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR ITS CONTENT, REGARDLESS OF THE LEGAL THEORY. OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIM RELATED TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).

You agree to defend, indemnify, and hold harmless VYAN AI from and against any claims, liabilities, damages, costs, and expenses (including reasonable attorneys' fees) arising out of your breach of these Terms, your misuse of the Site, or your violation of any third party's rights.

We may revise these Terms from time to time. If we make material changes, we will post the revised Terms on this page and update the Effective date. Continued use of the Site after revisions are posted constitutes your acceptance of them.

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles. Any dispute arising out of or related to these Terms or your use of the Site will be brought exclusively in the state or federal courts located in Alameda County, California, and you consent to personal jurisdiction there.
